Aiea Pearl City Dental Care LLP offers SMS/text messaging services for the following purposes:

• Continuing care and recall reminders
• Billing, payment, and administrative notifications
• Insurance-related communications
• Customer service and patient support communications
• Operational and healthcare-related communications as permitted by applicable law

Message frequency may vary based on your appointment schedule, billing activity, and communication preferences.

By providing your mobile phone number and opting into our SMS communications, you authorize Aiea Pearl City Dental Care LLP to send recurring automated and non-automated text messages, which may be transmitted using an automatic telephone dialing system (ATDS) or other communication technology, to the extent permitted by applicable law, including the TCPA and applicable FCC regulations.

Message and data rates may apply depending on your wireless service plan. You are solely responsible for all charges imposed by your mobile carrier in connection with SMS communications from this practice.

To stop receiving text messages from this practice, reply STOP to any message at any time. After opting out, you may receive a single one-time confirmation message. Opting out of SMS communications will not affect your right to receive dental care or services from this practice, nor will it affect other forms of communication we may use to reach you.

Your use of our SMS services is also governed by our SMS/Text Messaging Privacy Policy, which is incorporated herein by reference. By agreeing to these Terms, you also acknowledge and accept the terms of our Privacy Policy.

Wireless carriers are not liable for any delayed or undelivered messages. Delivery of SMS messages depends on your carrier's network and applicable technology and is not guaranteed by this practice.

Standard text messaging may not always be encrypted and is not guaranteed to be a fully secure method of communication. By participating in SMS communications with this practice, you acknowledge and accept the inherent risks associated with electronic communications, including potential unauthorized access or disclosure.

You acknowledge that message notifications, shared family devices, lock-screen previews, wireless carrier systems, or device-specific settings outside the control of Aiea Pearl City Dental Care LLP may expose communications to unintended third parties.

You agree not to use our SMS services for any unlawful or prohibited purpose, including:

• Using SMS services for unlawful purposes or in violation of applicable law
• Interfering with or disrupting our communication systems or networks
• Sending abusive, threatening, harassing, defamatory, or fraudulent communications
• Impersonating any person or entity
• Attempting unauthorized access to our systems, data, or communications

We reserve the right to suspend or terminate your access to SMS communications for misuse or violation of these Terms without prior notice.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, AIEA PEARL CITY DENTAL CARE LLP AND ITS OWNERS, PARTNERS, DENTISTS, EMPLOYEES, AFFILIATED ENTITIES, AGENTS, REPRESENTATIVES, SUCCESSORS, AND ASSIGNS SHALL NOT BE LIABLE FOR:

• Delayed or failed message delivery
• Wireless carrier failures, network outages, or service interruptions
• Unauthorized access to information transmitted via SMS
• Technical failures or malfunctions
• Data loss or corruption arising from use of SMS communications
• Your reliance on SMS communications for time-sensitive matters
• Any indirect, incidental, consequential, special, exemplary, or punitive damages, regardless of the theory of liability

Some jurisdictions do not allow the exclusion or limitation of certain categories of damages; accordingly, some of the above limitations may not apply to you.

You agree to indemnify, defend, and hold harmless Aiea Pearl City Dental Care LLP and its owners, partners, dentists, employees, contractors, agents, affiliates, successors, assigns, and vendors from and against any and all claims, damages, liabilities, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your misuse of SMS services
• Your violation of these Terms
• Your violation of any applicable law, regulation, or ordinance
• Your infringement of any third-party right
• Unauthorized use of your mobile device or mobile phone number by a third party

These Terms shall be governed by and construed in accordance with the laws of the State of Hawaii, without regard to its conflict of law principles. Any disputes arising out of or relating to these Terms or our SMS services shall be subject to the exclusive jurisdiction of the state and federal courts located in the State of Hawaii.

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable, consistent with the parties' original intent.

We reserve the right to update or modify these Terms at any time. Updated Terms may be posted on our website or otherwise made available to patients through appropriate channels. Your continued participation in our SMS services following the effective date of any modification constitutes your acceptance of the revised Terms.
